Terms of Service for Iron City Guns and Ammo LLC

Welcome to Iron City Guns and Ammo LLC! By accessing or using our website, purchasing any products, or engaging with our services, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you don’t agree with any part of these terms, you must not use our website or services.

We may update these Terms of Service periodically. Your continued use of our website and services after any changes means you accept the revised terms.

1. Eligibility and Legal Compliance

When you place an order with Iron City Guns and Ammo LLC, you confirm that:

• You are at least 18 or 21 years of age, as required by federal, state, and local laws for the specific products you’re buying (e.g., 21 for handguns and handgun ammunition).
• You are not legally prohibited from purchasing, possessing, or owning firearms, ammunition, or any other items we offer. This includes, but isn’t limited to, individuals convicted of felonies, those subject to domestic violence restraining orders, or those dishonorably discharged from the armed forces.
• Please be aware that while marijuana may be legal under your state’s law, the use or possession of marijuana, including for medical purposes, remains illegal under federal law. Federal law prohibits individuals who use or are addicted to marijuana from purchasing or possessing firearms.
• You are the actual buyer of the product(s) and aren’t buying for any prohibited person.
• You understand and will comply with all federal, state, and local laws and regulations regarding the purchase, ownership, and use of any items you acquire from us.
• You live in a jurisdiction where the products you’re buying are legal to own.
• If, for any reason, a restricted item (such as a firearm) ordered from our website is not approved, not picked up, or must be returned from the FFL dealer for any reason (e.g., failed background check, state/local restrictions, customer refusal), you will be responsible for the shipping costs both ways, in addition to a 15% restocking fee.

While Iron City Guns and Ammo LLC strives to stay current on all local, state, and federal firearms laws and regulations, it is ultimately your sole responsibility to know and comply with all applicable laws. We can’t provide legal advice. Any information on our website is for general purposes only and isn’t a substitute for legal counsel.

2. Product Information and Disclaimers

We strive to provide accurate product descriptions, images, and pricing. However, we don’t guarantee that all content on this site is entirely accurate, complete, reliable, current, or error-free. All products are sold “as is.”

• Product images are for illustration and might not perfectly reflect the actual item due to manufacturing variations, lighting, or your device’s display settings.
• Prices can change without notice.

3. Ordering, Payment, and Order Acceptance

• All prices are listed in U.S. Dollars (USD).
• We accept major credit cards (Visa, MasterCard, American Express, Discover). By submitting an order, you authorize us to charge your selected payment method for the total amount, including shipping and applicable taxes.
• Receiving an order confirmation email doesn’t mean we’ve accepted your order or confirmed our offer to sell. We reserve the right to accept or decline your order for any reason at any time after we receive it.
• We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

4. Shipping and Delivery

• Firearms: All firearms must be shipped to a Federal Firearm License (FFL) holder in your state of residence or a state where the transfer is legal. You’re responsible for contacting your chosen FFL dealer and ensuring they’re willing to accept the transfer on your behalf before placing your order. We need a legible copy of your FFL dealer’s license before shipping. Transfers are subject to your FFL dealer’s policies and fees.
• Ammunition: Ammunition will be shipped directly to your provided shipping address if permitted by law. We won’t ship ammunition to P.O. boxes.
• General Shipping: Shipping costs and estimated delivery times are provided at checkout. We’re not responsible for delays caused by shipping carriers or unforeseen circumstances.
• Inspection upon Delivery: Please inspect all packages when they arrive. If an item appears damaged during shipping, refuse delivery and contact us immediately.
• Risk of Loss: The risk of loss for items purchased from Iron City Guns and Ammo LLC passes to you once we deliver them to the carrier.
• Adult Signature: An adult signature might be required upon delivery for certain products.

5. Returns, Refunds, and Cancellations

Due to the nature of our products and strict regulations, our return policy is as follows:

• Firearms and Ammunition Sales are Final: Once a firearm has been shipped to your chosen FFL dealer and transferred into your possession (or the background check has cleared), the sale is final. We can’t accept returns on firearms or ammunition for any reason. For any defects, malfunctions, or warranty claims related to a firearm or ammunition after you have accepted the transfer, you must work directly with the manufacturer.
• Accessories: Returns for accessories may be accepted within 30 days of receipt, provided the item is in new, unused, and undamaged condition with all original packaging. All accessory returns are subject to a 15% restocking fee. You’re responsible for shipping costs for returns.
• Defective Products (Before Transfer/Non-Firearm): If you receive a defective product (excluding firearms after transfer or shipping damage, which you must report as per Section 4), please contact us immediately. We’ll work with you to resolve the issue in accordance with the manufacturer’s warranty.
• Order Cancellations: You can request to cancel an order before it has shipped. Once an order has shipped, it can’t be canceled. A cancellation fee may apply.

6. User Accounts and Security

If you create an account with us, you’re responsible for keeping your account and password confidential and for restricting access to your computer. You agree to accept responsibility for all activities that happen under your account or password. You agree to notify us immediately of any unauthorized use of your account.

7. Intellectual Property

All content on this website, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Iron City Guns and Ammo LLC or its content suppliers and is protected by United States and international copyright laws. You can’t use any content from our site without our express written permission.

8. Limitation of Liability and Disclaimer of Warranties

Iron City Guns and Ammo LLC and its directors, officers, employees, affiliates, agents, contractors, suppliers, or licensors will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of our services or products, or for any other claim related in any way to your use of our services or any product.

We don’t guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. We don’t warrant that the results you might get from using the service will be accurate or reliable.

9. Indemnification

You agree to indemnify, defend, and hold harmless Iron City Guns and Ammo LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

10. Governing Law and Dispute Resolution

These Terms of Service and any separate agreements where we provide you services are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms of Service will be resolved exclusively through binding arbitration in Eagle Mountain, Utah, in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration will be conducted by a single arbitrator. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

11. Severability

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision will still be enforceable to the fullest extent permitted by applicable law, and the unenforceable part will be considered removed from these Terms of Service. This won’t affect the validity and enforceability of any other remaining provisions.

12. Entire Agreement

These Terms of Service and any policies or operating rules posted by us on this site or regarding the service make up the entire agreement and understanding between you and us and govern your use of the service. They supersede any prior or contemporary agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
